New Delhi: The Supreme Court in India has ruled that fatwas issued by either Shariat courts or muftis had no legal sanctity and declared that the resistance of fatwas will have neither civil nor criminal consequences.
According to the court, it would be illegal to enforce such religion-based opinions on citizens for personal issues regarding the violation of their fundamental rights.
The court said that fatwa has no place under the constitutional scheme of independent India irrespective of its status during Mughal or British rule.
The court added that the process of enforcing fatwa by any method shall be illegal and instructed to deal the same with respect to the law.
